1. Eligibility

You must be at least 18 years old to create a hummOut account. By using the app, you confirm you meet this requirement.

2. Your account

You're responsible for the accuracy of the information you provide and for keeping your account secure. You may not create more than one account, share your account, or attempt to circumvent a suspension by creating a new account.

3. Community guidelines and conduct

hummOut connects people for real-world activities. You agree to:

• Treat other users respectfully and follow the law when attending or hosting events.
• Not use the app to harass, threaten, or harm others.
• Not submit false, misleading, or someone else's identity documents or photos during Circle verification.

We may investigate reports, warn, suspend, or permanently ban accounts that violate these terms, at our discretion.

Meeting in person is at your own risk. hummOut does not conduct background checks beyond the identity-verification process described in our Privacy Policy, and cannot guarantee the conduct, identity, or safety of any user or event. Use good judgment when meeting people or attending events found through the app.

4. Circle membership and payments

Circle is a paid membership tier offering additional features (see the app for current benefits and pricing). Circle membership is purchased through the Apple App Store or Google Play and billed according to the terms of the store you purchased through.

• Verification: access to Circle requires identity verification (government ID or linked social account, plus a selfie), reviewed by our team. We may reject a verification attempt or, after approval, revoke Circle access if we later determine the verification was fraudulent or you've violated these terms.
• Refunds: refund requests are handled per the policies of the app store you purchased through (Apple App Store or Google Play). We may also process a refund directly through our payment processor in specific cases (e.g. a rejected verification after payment) at our discretion.
• Auto-renewal: monthly Circle subscriptions renew automatically until cancelled. You can manage or cancel your subscription through your Apple ID or Google Play account settings.
• Lifetime tiers: certain launch-phase memberships (e.g. Founding, Early) are one-time purchases that do not renew or expire.

5. Events

Hosts are responsible for the accuracy of the events they create and for conducting them safely and legally. hummOut is a platform for discovering and organizing activities — we are not a party to, and are not responsible for, what happens at any event.

6. Content

You retain ownership of content you post (event listings, profile information, etc.), but grant hummOut a license to display and use it as necessary to operate the app. You're responsible for ensuring you have the right to post any content you submit.

7. Account termination

You may delete your account at any time (see our Privacy Policy for how). We may suspend or terminate your account for violating these terms. If your account is suspended, you may not create a new account to evade that suspension — see our Privacy Policy for the limited data we retain to enforce this.

8. Disclaimer and limitation of liability

The app is provided "as is." To the fullest extent permitted by law, hummOut disclaims warranties of any kind and is not liable for damages arising from your use of the app, interactions with other users, or events discovered through the app, including but not limited to any harm arising from in-person meetings.

9. Changes to these terms

We may update these terms from time to time. Continued use of the app after a change means you accept the updated terms.
