These Terms and Conditions ("Terms") govern your use of the Jaap108 Android application (the "App"). Jaap108 is provided by Roshan Kumar, an independent developer operating under the name hummOut ("hummOut," "we," "us," or "our").

By downloading, accessing, purchasing through, or using the App, you agree to these Terms and the Jaap108 Privacy Policy. If you do not agree, do not use the App.

1. The Jaap108 Service

Jaap108 provides a digital mala (counting) tool for mantra japa and similar contemplative counting practices. Features may include mantra selection, count targets, mala theme visuals and interactions, streak tracking, and an optional daily reminder.

Available features, themes, mantras, count options, and monetization may evolve over time. We will not remove already-purchased access to a theme or ad-removal entitlement except where required for security, law, store policy, misuse, or circumstances outside our reasonable control.

2. Informational and Practice Disclaimer

Jaap108 is a counting utility intended to support personal contemplative, devotional, or mindfulness practice. It is not religious instruction, spiritual guidance, medical advice, or a substitute for professional guidance of any kind. Mantra content, translations, and descriptions are provided for general practice support and educational context only.

We do not guarantee the theological accuracy, regional pronunciation, or tradition-specific correctness of any mantra text displayed in the App. You remain responsible for how you choose to use the App as part of your own practice.

3. User Information and Local Data

You are responsible for the accuracy of any name you optionally enter during onboarding. Jaap108 stores your name, mantra selection, counts, streaks, theme, and language preference locally as described in the Privacy Policy. Uninstalling the App, clearing its storage, or losing the device may permanently remove this local data.

4. Licence and Permitted Use

Subject to these Terms, hummOut grants you a limited, personal, revocable, non-exclusive, non-transferable licence to install and use the App on devices you control for lawful, non-commercial purposes.

You must not:

• copy, sell, sublicense, rent, distribute, or commercially exploit the App or its content except as expressly allowed by law;
• reverse engineer, decompile, bypass, tamper with, or attempt unauthorized access to the App, purchase validation, ads, or entitlements, except where a restriction is prohibited by law;
• use automation, fraudulent transactions, invalid ad activity, or deceptive methods to obtain benefits;
• interfere with the App, Google Play, AdMob, or other users; or
• remove copyright, trademark, attribution, or proprietary notices.

5. Free Access and Advertising

The free version currently provides two mala themes (Simple Counter and Single Bead), all count options, mantra selection, streak tracking, and banner advertising. An optional rewarded advertisement may temporarily unlock a premium theme for trial use when an eligible ad is available and its reward is completed.

Ad availability is not guaranteed. Closing an ad before earning the reward, declining consent where ads cannot lawfully be requested, network failure, ad inventory shortages, or an advertising error may prevent a trial from being granted. We may reasonably modify free limits or advertising arrangements in future versions.

6. Paid Content

Jaap108 may offer the following one-time, non-consumable purchases through Google Play:

• Remove Ads: permanently removes banner ads and unlocks the Realistic Mala theme. Rewarded ads may still appear as an optional way to preview other locked premium themes for one round before purchasing Theme Pack or Ultimate.
• Theme Pack: permanently unlocks the premium mala themes (Realistic Mala, Tulsi Mala, Rudraksha Mala, Crystal Mala, and Temple Theme).
• Ultimate: combines ad removal with all premium themes.

These are one-time purchases, not subscriptions — there is no recurring billing or auto-renewal. The price, currency, and applicable taxes displayed by Jaap108 and Google Play immediately before purchase are the terms applicable to that transaction. No purchase is required to use the App's free features.

7. Billing and Restoring Purchases

Payments are processed by Google Play and charged to the Google account confirmed during purchase. We do not directly receive your complete payment-card or bank-account details.

Jaap108 provides a user-initiated Restore Purchases function to re-apply eligible entitlements (such as Remove Ads or the Theme Pack) to the same Google account on a new device. Restoration requires an internet connection and Google Play availability, and restores purchase entitlements only — not locally stored counts, streaks, or preferences.

8. Refunds

Purchases are made through Google Play. Refund eligibility and processing are subject to Google Play's policies, the transaction circumstances, and applicable consumer law. Requests should ordinarily be submitted through Google Play using the applicable order and account.

If Google Play does not resolve a billing complaint, you may contact hummOut at the address in Section 15. Nothing in these Terms limits refund, cancellation, or other consumer rights that cannot lawfully be excluded. 9. Third-Party Services

The App relies on third-party software and services, including Google Play, Google AdMob, and Google's User Messaging Platform. Your use of those services may also be governed by their terms and policies. We do not control a third party's independent payment systems, ad content, availability, policies, or decisions.

10. Intellectual Property

The App's original software, interface, branding, mala theme designs, and original content are owned by or licensed to hummOut and are protected by applicable intellectual-property laws. Mantra texts and traditional content remain in the public domain or subject to their respective sources. "Jaap108" and "hummOut" are used as product and publisher identifiers. No rights are granted except the limited licence expressly stated in these Terms.

11. Availability, Updates, and Changes

We may release updates, correct errors, modify functionality, discontinue unsupported features, or temporarily restrict access for maintenance, security, legal, technical, or store-policy reasons. We do not guarantee that every feature will remain available forever or work on every device.

12. Suspension and Termination

You may stop using the App at any time by uninstalling it. We may restrict or terminate access where reasonably necessary because of material breach, fraud, abuse, security risk, legal requirement, store action, or discontinuation of the App. Provisions that by their nature should survive termination — including disclaimers, intellectual-property provisions, and liability limitations — will survive.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Jaap108 is provided "as is" and "as available," without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or specific results. This section does not exclude warranties or rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Roshan Kumar and hummOut will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss; loss of profits, opportunity, goodwill, or data; or third-party conduct. Nothing in these Terms excludes liability that law does not permit to be excluded or limited.

15. Governing Law and Contact

These Terms are governed by the laws of India. Because Jaap108 is operated from Delhi, courts at New Delhi will have jurisdiction where legally competent. This clause does not prevent a consumer from approaching a forum available under mandatory local law. Before beginning formal proceedings, you are encouraged to contact us and make a good-faith attempt to resolve the issue informally.

Use the subject "Jaap108 Grievance" and include the Google Play order reference where relevant. We aim to acknowledge grievances within 48 hours and resolve them within one month.

16. Changes to These Terms

We may update these Terms to reflect changes in the App, paid content, third-party services, law, or policy. The updated date will appear at the top. Your continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

17. Severability and Entire Agreement

If a provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will continue in effect. These Terms and the Privacy Policy form the agreement between you and hummOut concerning the App.
